The terms for using BotanAI

The short version: the app is yours to use, it costs nothing for the core features, what you create stays on your phone, and any plant it identifies or advises on is a starting point rather than the final word. The sections below say all of that in the language a lawyer needs.

By downloading, installing, or using the BotanAI mobile app, or by using this website at botanai.app, you agree to these Terms of Service. If you do not agree, please do not use the app or the site. If you are under the age of majority where you live, you may use BotanAI only with the involvement of a parent or guardian.

BotanAI is a plant app that runs on your device. There is no BotanAI account and no sign-in of any kind, and there is no BotanAI server that holds your data. Your garden, plants, photos, growth timeline, care logs, AI Plant Doctor history, wishlist, settings, and all community content are stored only on your device.

The app provides:

• Plant identification, tried on your device first and escalated to outside services only when your phone is not confident.
• An AI Plant Doctor text chat, and disease or health checks from a photo.
• A light meter, weather-smart care reminders, and a growth timeline.
• Local, single-device community features that stay on your phone.
• An optional paid tier, BotanAI Pro, sold through Google Play.

Identification and some health checks rely on independent processors, described in the privacy policy. When those services are used, only what is needed for that one feature leaves your device. Your continued use of those parts of the app depends on those third parties remaining available, which is not something we control.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use BotanAI on devices you own or control, for your own non-commercial use, subject to these terms and to the Google Play terms. The app, its name, its logo, and its software are ours or our licensors, and this licence does not transfer any of that ownership to you.

Anything you create in the app, including photos, notes, care logs, and posts in the local community features, belongs to you. Because the app has no accounts and no server, this content is stored only on your device and is not transmitted to BotanAI or to other users. We do not receive it, host it, or display it, so you are not granting us any licence to it. There is nothing here for us to license, and we ask for nothing.

The exception is content you deliberately send outside the app, such as a photo you share with a friend using your phone, or a message you send us for support. In those cases you are choosing to transmit it, and you are responsible for having the right to do so.

When using BotanAI you agree not to:

• Break any applicable law or regulation.
• Reverse engineer, decompile, or tamper with the app except where the law expressly permits it.
• Upload malicious code, or try to disrupt, overload, or gain unauthorised access to the app or the services it relies on.
• Scrape, copy, or redistribute the app or the content of this website beyond what these terms or the law allow.
• Use the app to infringe someone else’s rights, including by identifying or photographing plants you have no right to access.

Plant identification can be wrong. It is a best effort by software and by third-party services, not a determination by a botanist. Identifications, care suggestions, disease or health assessments, and anything else the app tells you are provided for general information only. They are not professional, medical, veterinary, horticultural, or safety advice, and you should not treat them as such.

Do not rely on BotanAI to decide if a plant is safe

Do not rely on the app to decide whether a plant, or any part of it, is safe to eat, to touch, or to have around children, pets, or livestock. A confident-looking answer can still be a wrong one. Before you act on anything that carries a health or safety consequence, confirm it with a qualified professional, such as a botanist, doctor, veterinarian, or poison control service. You use the app’s output at your own risk.

The core features of BotanAI are free. BotanAI Pro is an optional subscription that removes the free tier’s cap on the number of plants in your garden. Pro is sold and billed through Google Play, and any purchase is a transaction between you and Google under the Google Play terms. We do not process or store your payment details.

The price shown in the app is the price set in Google Play for your region and is displayed before you buy. A subscription renews automatically until you cancel it. You can cancel at any time in Google Play, and cancellation takes effect at the end of the current billing period. Refunds are handled under Google Play’s refund policy. The app and the website are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error free, or that any identification or information it provides is accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

To the maximum extent permitted by law, BotanAI and the people behind it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the app or the website. To the extent liability cannot be excluded, our total liability to you for all claims is limited to the amount you paid for BotanAI Pro in the twelve months before the event giving rise to the claim, or ten US dollars, whichever is greater. Nothing in these terms limits any liability that cannot be limited under applicable law.

BotanAI relies on independent services for identification, health checks, the AI Plant Doctor, weather, crash reporting, and billing. These are listed, with exactly what each one receives, in the privacy policy. Your use of those services is also governed by their own terms and privacy policies, and we are not responsible for how those third parties operate.

We may update these terms from time to time. When we do, we will change the “last updated” date at the top of this page, and for significant changes we will give more prominent notice. Continuing to use BotanAI after an update means you accept the revised terms. If you do not agree to a change, stop using the app; you can remove it and your data at any time by uninstalling it or clearing its storage.

These terms are governed by the laws of [GOVERNING JURISDICTION TO BE SET], without regard to its conflict-of-laws rules, and any dispute will be subject to the courts of that jurisdiction, except where mandatory local consumer law gives you a different right. This placeholder will be replaced with the operating jurisdiction before these terms are treated as final.

If any part of these terms is found unenforceable, that part is limited or removed to the minimum extent necessary, and the rest stays in full effect.
